HASBROUCK HEIGHTS, NJ – Several Hasbrouck Heights residents addressed the Mayor and Council at the March 10th meeting, airing their concerns about the Ordinances on the agenda surrounding the Fair Share Housing Plan.

The ordinances, which were all passed earlier in the month by the Planning Board, adjust the master plan by creating overlay zones where multiple dwelling, affordable housing could be built, in the event that the property is sold and/or is re-developed. The Ordinances do not require any properties to be sold or converted at this time.

The overlay zones are:

The Borough Fair Share Housing consultant, Edward J. Snieckus, Jr. of Burgis Associates, addressed the concerns on behalf of the Council regarding the ordinances, and what they mean for the property owners.

Snieckus tried to make clear that these ordinances were not the desire of the Borough, but were needed to meet the requirements of a consent agreement made to ensure compliance with the Fair Housing Act.

Without the consent agreement, which the State required to be enacted by March 15th, Hasbrouck Heights could have lost control of its zoning regulations and been open to what is referred to as “Builder’s Remedy.” Builder’s Remedy would allow builders to meet Hasbrouck Heights affordable housing requirements as they see fit, regardless of what is good for the community or local zoning.

The overlays provide areas where, in the case of redevelopment in the future, affordable housing could be built in accordance with the “fair share set aside” in the Borough’s zoning laws. For multi-unit developments over five units, 20 percent must be set aside for affordable housing.

Affordable housing is defined as housing for the very poor, poor and middle-income residents. Current guidelines suggest that middle income would be approximately $70 thousand per year, according to Snieckus.

A few residents questioned the wisdom of the choices and the selection process. Mayor Ron Kistner assured residents that the choices were not made to harm their property values, and that while some of the choices seemed to be less than optimal, the ones excluded were even worse. Kistner was advised by Snieckus that he could not share the other locations with the public as they were part of legal proceedings.

Also questioned was whether the locations chosen could withstand further density, considering many of the issues that regularly come up at the meetings about traffic. One resident questioned whether or not this was considered when choosing these sites.

Snieckus responded that, under the law, it did not matter. He also noted that while these areas had been rezoned, they still had to come before the planning board and meet all the applicable zoning requirements if they were to be redeveloped.

Hasbrouck Heights, which has been one of Bergen County’s and Group 1’s top teams in the last few years, once again established itself as the top team in the NJIC with a 39-27 win over Emerson Boro in the finals of the NJIC Tournament.

The Aviators repeated as champions, after beating Manchester Regional in last year’s final and after beating Emerson 47-28 in a dual back on Jan. 3.

Heights county medalist Eoin Maloney pinned Nicholas Giella in the final bout at 175 to close things out for the Aviators as they led 33-27 heading into that bout. If Maloney got pinned, Emerson would’ve won on criteria — bouts won, with eight, with Maloney insisting instead that criteria wouldn’t be necessary.

Hasbrouck Heights got timely bonus points when it mattered, especially as Emerson narrowed the Heights lead late.

At one point, Heights led 27-9 with six bouts to go, before Emerson won the next four bouts and eventually tied the match late at 27-27 after Devin Deubel teched Emil Belyayev, 19-2, in 4:18 after he got pinned by Belyayev in the first dual meet.

At 165, Heights got a pin with 10 seconds left from Jayden Chicaza, who was trailing 8-5 at that point, setting up Malone in win-or-go-home territory.

The win pushed Heights to 14-2 on the season with their only two losses coming to Morris Hills and Cedar Grove. They have big wins over Roxbury, twice over Emerson, Old Tappan and North Bergen and they currently project as the No. 2 seed in North 2, Group 1.

Emerson, meanwhile, dropped to 11-4 as their two losses are to Heights, Cedar Grove and Westwood, the latter of whom also lost to Heights. The Cavos have big wins of their own with Roxbury, Pompton Lakes twice, Bridgewater-Raritan and Old Tappan.

They’re currently in strong position firmly atop the North 1, Group 1 playoff picture.
